The Severance Family file a new motion for an emergency hearing against the Pleasant View Homeowners Association. This new filing comes at the heels of a new cease and desist letter was sent to the Counsel of Pleasant View Homeowners Association. This letter outlined the violations that were required to be cured before they could be in compliance with the governng documents and Indiana Code for law enforcement. The letter goes on to explain that even officers of the court (lawyers) cannot hide from liability  because “they are expected to know the laws”. If the counsel of Pleasant View Homeowners Association allow the annual meeting to continue before resolving their standing violations, then their counsel could be liable for damages caused to the corporation by not abiding by the cease and desist letter and opting instead to ignore the Indiana Laws protecting non-profit corporations.
